All prices are quoted in Canadian Dollars including prices shown in our brochures or on our website. Guest(s) agree to pay the rental of the Condo-hotel/s for the duration of the Rental Convention and any/all applicable fees for additional services requested by the Occupant(s). Payment can be made to Executive Stays by: Company Check, Money Order, Bank Draft, Bank SWIFT Transfer, MasterCard, VISA, American Express and or Cash. Out of town Guest(s) are required to complete and return a Credit Card Authorization form and/or a Corporate Guarantee before their reservation is confirmed. For the duration of the reservation and any extension of it, the Guest(s) agrees to pay fees for the rental of the Condo-hotel and any additional chargeable services, which are utilized. If a Corporate Guarantee (refer to Corporate Guarantee for particulars) is arranged on behalf of the Guest(s), the person or entity named will be liable to pay all fees indicated and the Guest(s) will be responsible for paying all other fees, if any. Unless otherwise arranged or agreed, or a Corporate Guarantee is provided, a Guarantee Deposit depending on the duration of stay (usually 1 months rent), to be held on hold in case of incidentals or non respect of contract, and deducted without further notice to cover these incidentals or will be returned to the Guest(s), not exceeding 30 days following departure if there is no damages. All damages to the premises and its contents will be charged at replacement value. The Guest(s) agrees to inspect and notify Executive Stays through photos & email at info@Executive Staysmontreal.com, any and all damages in the Condo-hotel within 24hrs of occupancy, if nothing in received Executive Stays will assume all incidentals or damages were caused by Guest(s) during his/her occupancy and will therefore deduct it from the Guarantee deposit. If amounts of damages exceed the Guarantee deposit the Guest(s) agrees to reimburse Executive Stays the balance within 5 days in order to bring the Condo-hotel back into the same condition as it was given, if not Executive Stays take the necessary steps to remedy the issue with the Occupants Insurance, (Extra-Contractual & Civil). All new Rental Conventions one month or less must be paid in full upon check-in, any reservation for longer than one month will be charged on a monthly basis after the initial payment. In the case of late payment, a daily penalty of 1% of the monthly rent will be charged following the rent due date and a $50.00 service charge will be implemented for all returned checks. We reserve the right to evict Guest(s) and terminate any Rental Convention if payment does not reach us within 7 days after the rent due date.
The Guest(s) agree to indemnify Executive Stays against loss, injury/health, damage, cost, action, or cause of action of any nature whatsoever caused by any of the Guest(s), Permitted Occupant(s) or of any person they invite into the Condo-hotel. Executive Stays is not liable in any way for any lost, damaged or stolen items of the Guest(s) used or contained in the Condo-hotel during the Guest(s) stay or left in the Condo-hotel once the Guest(s) has vacated. The Guest(s) hereby releases, remises, and forever discharges Executive Stays, its Officers, Directors, Managers, Employees, Agents and Contractors, from any and all liability, injury, loss and damages, including personal injury and death that may arise from or in relation to the Guest(s) exclusive possession of the Condo-hotel including use of the Condo-hotel & its contents until the Departure Date, whenever or however they occur. The Guest(s) are also responsible for maintaining all practical care of the Condo-hotel and its contents. Except in the case of normal wear and tear, the Guest(s) are responsible for any damage to the Condo-hotel or its contents during their stay which has occurred due to the negligence, willful default or irresponsible behaviour on the part of the Guest(s) will ensure that nothing is done which may jeopardize the dwellings’ insurance policy or any part of it in respect of the Condo-hotel and its contents. The Guest(s) and occupants are advised to maintain appropriate liability insurance and homeowners and/or occupants insurance for their own personal possessions or ask a Executive Stays employee to recommend an Insurance provider. Without prejudice to any other right or remedy Executive Stays may have, the Guest(s) forfeit their guarantee deposit (or an appropriate proportion of it) if they do not respect the Terms and Conditions set forth herein.
The Guest(s) are requested to vacate their Condo-hotel by 10:30 A.M. and arriving guests to check-in after 4:00 P.M. Changes require by the Guest(s) on the departure and arrival time must be reported to Executive Stays for confirmation of availability of change. Return or pick-up of keys, passes, and remotes will be made available during regular business hours. Upon request, prior arrangements can be made for return or pick-up after business hours, weekends and holidays. If there is any delay in vacating the Condo-hotel beyond the agreed time, a full day’s rental, calculated at the daily rate applicable may be charged to the Guest(s).
Any changes modified in a confirmed Leasing Agreement may be subject to an administration charge of $50.00 per reservation. Acceptance of changes in check-in dates remains at the sole discretion of Executive Stays and may be viewed as a cancellation. Early checkout dates will be subject to a penalty of the full balance left on the Rental Convention. In extreme circumstances Executive Stays may find it necessary to cancel a reservation and if so, Executive Stays shall make all practical efforts to offer a comparable alternative. If this is not acceptable, Executive Stays will refund any sum paid in advance; which shall constitute full and final settlement of any liability Executive Stays may have as a result of such cancelation.
You must notify us in writing either by Email or Registered letter for any reservation cancellation. Cancelling a confirmed reservation will be subject to forfeiture of deposit & penalties depending on Vacation Rental.
Executive Stays’s published rates are subject to change without notice. Reconfirm rates on all reservations, extensions or new rental conventions. In-house Guest(s) staying greater than one (1) month and who are paying a monthly rate will be given one (1) month’s prior notice of any rate change. Any Guest(s) whose original reservation is for one (1) month or greater and who advises Executive Stays of an earlier than scheduled check-out having the effect of reducing the Rental Convention to less than THIRTY (30) days, will be subject to a corresponding rate change to the higher weekly or nightly rate, as applicable if possible, if not the occupant will be responsible to pay for the remaining term left in their stay/lease. All such reductions in duration will also be subject to the applicable taxes if less than (1) month rental. Executive Stays will revise the original billing in this regard and charge the Guest(s) accordingly. Executive Stays reserves the right to change at anytime, any of the pricing/contents advertised on www.Executive Staysmontreal.comwebsite at their discretion.
If the Guest(s) should find accommodations to be other than as represented, Executive Stays will make every effort to remedy the problem, and in extreme situations will attempt to move the Guest(s) to another Condo-hotel if available. In the event a substitute Condo-hotel is found which rents at a higher rate than originally booked, the Guest(s) may be asked to pay the difference. If this is not possible, or is unacceptable, all monies received by Executive Stays will be refunded as full and final settlement of any claims. While Executive Stays will do everything possible to accommodate the Guest(s) needs, Executive Stays is not responsible for situations and conditions which are beyond our control such as: bad weather, airline delays, labor strikes or the failure of a previous Guest(s) to vacate the Condo-hotel.
Executive Stays has the right to terminate a Rental Convention at any time on the grounds of abuse to staff or other Guest(s), mistreatment of the Condo-hotel or criminal activity on the part of those occupying the Condo-hotel or their guests. In such circumstances Executive Stays is not obliged to provide or locate alternative accommodation. This applies also In the event of Force Majeure by reason of strikes, lockouts, unavailability of materials, power failure, restrictive government laws or regulations, riots, insurrections, the act, failure to act, or default of the other party, bad weather, war or other reason beyond its control. The period of notice and the refund applicable are entirely at the discretion of Executive Stays.
Guest(s) and all other occupants acknowledge and agree to comply with By-Laws and Rules & Regulations of the Building and/or condominium association during the term of the contract, failing to do so, Executive Stays has the right to terminate the contract for misconduct without refund. Guest(s) and all other occupants must keep their personal belongings inside the Condo-hotel (bicycles, shoes, doormats, carriages, umbrellas etc.) are not permitted to be left in the hallways or passageways. It is forbidden to: 1) Cause a disturbance or interference of comfort to other residents of the building 2) Cook outside of the kitchen area 3) Block toilets, sinks, tubs or other water fixtures with garbage or other substances will be at occupants expense 4) BBQ on the balconies or terraces (Gas Only) 5) Hang clothes, towels or bathing suits on balconies, windows or terraces 6) Post any ads, notices or any other signs anywhere in the buildings 7) Remove dishes, cookware or any other equipment or furnishings from the Condo-hotel 8) Use Roller Blades, bicycles, any tires with metal/spikes or skateboards in all areas of the building or parking area 9) Leave windows open when Condo-hotel is not inhabited 10) Change Locks, duplicate keys or Install additional locking devices on any doors without permission 11)Leave garbage or debris in any common area not designated for waste disposal 12) Leave children under the age of twelve (12) unattended in any common areas of the building 13) Remove or tamper with smoke detectors or fire extinguishers 14) Cause any disturbance to fellow neighbours and other occupants 15) Sublease, assign, or license the use of the property without consent of Lessor 16) In the event of Subleasing approval from Lessor, the Occupant will remain jointly and severally responsible for all payments to fulfill rental convention 17)Windows are a rented premises and all Broken ones will be at Occupants expense 18) Occupants shall not keep, use or sell anything prohibited by any policy of fire insurance covering the demised premises 19) Occupant(s) are required to have an Insurance Policy minimum 2million dollars for Civil Liability, Fire and damages exceeding their deposit *** IT IS STRICTLY FORBIDDEN TO MOVE THE FURNITURES Guest(s) may not solicit or peddle, nor use their Condo-hotel for other than residential or tourist purposes. An excessive level of noise will not be tolerated at any time.
Only persons notified to Executive Stays in advance may occupy the Condo-hotel overnight. Guest(s) are not permitted to sublet the Condo-hotel to any other third party. The number of persons permitted to occupy the Condo-hotel is limited to the number indicated on the Leasing Contract including children and overnight guests. Executive Stays reserves the right to refuse admittance to the Condo-hotel if this condition is not complied with.
In accordance with Canadian Law, and for the comfort of all its guests, Executive Stays offers a smoke free environment. There will be No Smoking or burning of candles or incense permitted in any property managed by Executive Stays. Individuals smoking in the Condo-hotels will be subject to eviction and responsible for complete sanitation, restoration costs and damages.
Some but not all, of the properties where Executive Stays has Condo-hotel’s permits pets: For any Condo-hotels where pets are permitted, a Pet Agreement must be signed by any guest(s) wishing to accommodate their pet(s) & a mandatory Pet fee of $250.00 will be applied for all Pet(s) before entering in the Condo-hotel. Please refer to the Pet Agreement for particulars.
Executive Stays or its authorized Agents’ may at any time access the Condo-hotel for the purpose of inspection of the Condo-hotel, and to carry out repairs or maintenance work. Executive Stays will make every effort to give advance notice to the Guest(s). Executive Stays reserves the right to access the Condo-hotel for the purpose of client visits, after 24 hours of notice by email or telephone (message left), even without any feedback from the occupant. In the event of an emergency it will be without notice.
All Condo-hotels are fully furnished to a high standard and include a fully operational kitchen with appliances, cutlery, and kitchen utensils. No food is provided. Condo-hotels are equipped with entertainment centre, quality linens and towels. A full inventory of equipment and utensils will be in the Condo-hotels, it is the Guest (s) responsibility to ask for the Inventory list if they are not able to retrieve it upon check-in otherwise Executive Stays will assume it was received and accepted with all contents included in perfect condition. No items may be removed from the Condo-hotel. Guest(s) will be responsible for normal upkeep of the Condo-hotel for stays over 45 days, i.e. replacement of light bulbs, cleaning laundry filters etc. The Condo-hotel includes heating, electricity/ (gas), water, Internet connection, local telephone service, and digital cable television. Any extra facilities and charges are solely at Executive Stays’s discretion.
15A. Damaged or Lost Keys/Locksmith Services Guest(s) shall be responsible for the costs of replacing lost Keys, Locksmith Displacement charges or for any damage caused by abuse or neglect. There will be a minimum charge of $100.00 for lost keys, and minimum of $150.00 up to $500.00 for each of the following lost items: remote fobs, security/parking passes, and garage door remote controls. A lock out charge of $75.00 will be billed to the Guest(s) account for any required re-access to their Condo-hotel.
15B. Telephone Local calls are complimentary with the exception of “Smart Tone Services” (i.e.: *calls), and directory assistance. Guest(s) are responsible for all long distance charges made from their Condo-hotel during their stay and are advised to use calling cards. There will be a minimum $25.00 administration fee per month charged for long distance usage. Long distance charges will be posted to the Guest(s) account once received from the long-distance carrier and a copy will be provided to the Guest(s). Rates for all telephone charges are in accordance to the telephone carriers. Voicemail or Answering Machine instructions are provided in each Condo-hotel if available only. Guest(s) who alter the communications/service provider, without consent of Executive Stays will incur a $150.00 service fee charged to their account.
15C. Television & Internet Basic cable and/or digital television are provided in each Condo-hotel. Any additional services, such as movie rentals or additional channels will incur fees and administration fees. Each Condo-hotel has been equipped with a modem for H/S Internet. A maximum of 10GB for up/downloading is included; any amount over the maximum allowed limit will be automatically charged for the excess usage on the Guest(s) account. Please keep in mind if you are using the Internet for gaming or streaming you are doing so at your own risk, and can easily surpass the maximum usage limit. Wireless service is available in all Condo-hotels, guest(s) will be charged a $100.00 fee if they alter the already set Wireless username and or passwords. In order to provide these services to our Guest(s), Executive Stays has installed a modem and/or a television receiver. Upon departure, all equipment must remain in the Condo-hotel or the Guest(s) will be responsible for a charge of $300.00 for replacement of the modem and/or receiver.
15D. Housekeeping & Utilities Guest(s) are responsible for maintaining the overall cleanliness and condition of the interior of the Condo-hotels. Upon departure, Guest(s) are expected to leave the Condo-hotel in the same condition that we have provided. Extra housekeeping charges will apply for any Condo-hotel, which requires more time than normally allocated for a check out cleaning to return the Condo-hotel to Executive Stays standards. Executive Stays conducts a final cleaning starting at a minimum of $175.00 depending on Condo-hotel size, for a standard cleaning, and inspection of each Condo-hotel upon Guest(s) departure. Basic Utilities (electricity, hot water, heating, air-conditioning, etc.) are included in the rental rate. However, the Guest(s) must insure that all lights and small appliances are turned-off, air-conditioning & heating units should be turned down to save energy when the Condo-hotel is not occupied & especially upon final departure. Extra charges may apply if any utility bill rises above and beyond the standard usage costs for the specific Condo-hotel rented & damages due to negligence: (Studios/1 Bedroom $50.00/month, 2 Bedrooms $80.00/month and 3 Bedrooms+ $120.00/month)
15E.Damages The Guest(s) will notify Executive Stays, with photo(s) of damages, by email within 24hrs. Otherwise Executive Stays will presume the Condo-hotel and its contents are in perfect condition resulting in any and all damages to be deducted from the Guarantee deposit in the event of incidentals.
We automatically log generic information about your computer’s connection to the Internet, which we call “session data”. Session data consists of things such as IP address, operating system and type of browser software being used and the activities conducted by the user while on our site. An IP address is a number that lets computers attached to the Internet, such as our web servers, know where to send data back to the user, such as the pages of the site the user wishes to view. We collect session data because it helps us analyze such things as what items visitors are likely to click on most, the way visitors are clicking through the site, how many visitors are surfing to various pages on the site, how long visitors to the site are staying and how often they are visiting. It also helps us diagnose problems with our servers and lets us better administer our systems. It is possible to determine from an IP address a visitor’s Internet Service Provider (ISP) and the approximate geographic location of his or her point of connectivity. We may also use some session data, such as the pages you visited on our site, to send you e-mail unless you had previously opted out of receiving such messages.
From time to time we may add or enhance services available on the site. To the extent these services are provided and used by you, we will use the information you provide to facilitate the service requested. For example, if you email us with a question, we will use your email address, phone number, name, nature of the question, etc. to respond to your question. We may also store such information to assist us in making the site the better and easier to use.
